1. Master Amazon’s Counterfeit Reporting Process
A common belief is that you must always perform a “test buy” before reporting a counterfeit listing on Amazon. While this is a powerful strategy, it’s not a universal requirement. Understanding the nuances of Amazon’s system is the first step to protecting your brand effectively.
A test buy—purchasing a suspected counterfeit to gather definitive proof—provides the strongest possible evidence for your claim. It allows you to photograph the inauthentic product, packaging, and shipping details to build an undeniable case. According to Amazon’s official policy, a test buy is necessary when you are reporting trademark or copyright infringement on a specific offer from a single seller on a product listing.


However, a test buy is not required when you are reporting an entire product detail page (ASIN) for infringement. In these “counterfeit without a test buy” situations, you must provide other compelling evidence. This can include screenshots of the listing, documented customer complaints about the item’s authenticity, and clear proof of your intellectual property rights, like trademark registration certificates.
For brands enrolled in Amazon Brand Registry, the process is more streamlined. The “Report a Violation” tool allows you to target infringing ASINs directly. While a test buy strengthens your claim within this system, it is not always a prerequisite to submitting a report. For brands in the invite-only Project Zero program, which have the power to remove counterfeit listings directly, a test buy is highly recommended to confirm the violation and avoid misuse of the tool.
Failing to perform a test buy doesn’t result in a direct penalty. The risk lies in submitting weak or unsubstantiated claims. If a rights owner repeatedly submits inaccurate reports, Amazon may revoke their access to reporting tools. A claim without the hard evidence of a test buy is also more easily challenged by an accused seller, who can appeal by providing their own evidence of authenticity, such as invoices from authorized distributors.
2. Extend Your Protection Across Other Major Marketplaces

Your brand protection strategy shouldn’t end with Amazon. Most major e-commerce platforms have dedicated programs to help you fight counterfeits. The key is to be proactive and register your intellectual property with each one.
Alibaba and AliExpress
Both platforms use a centralized Intellectual Property Protection (IPP) Platform. The first step is to register your trademarks, copyrights, and patents within their system. Once your IP is verified, you can submit complaints against infringing listings by providing the product URLs and evidence. A test buy can serve as powerful proof, but it is not explicitly required to initiate the complaint process.
Wish.com
Wish offers a Brand Partner Program that gives rights holders access to a dedicated portal for reporting infringing products. You can also report violations via an online form or email. Any report must be supported by information detailing the infringement and providing proof of your IP rights.
eBay
eBay’s long-standing Verified Rights Owner (VeRO) Program is the primary tool for IP protection. After enrolling in the program, you can report listings that infringe on your rights by submitting a Notice of Claimed Infringement (NOCI). eBay acts on these notices, and sellers who are repeatedly flagged for violations face restrictions or account suspension.

Facebook Marketplace
Facebook has a formal intellectual property reporting system. Rights holders can use specific online forms to report counterfeit goods, trademark violations, or copyright infringements. The platform’s Commerce Policies strictly prohibit the sale of counterfeit items, and leveraging their reporting tools is the most effective way to have listings removed.
Walmart Marketplace
Walmart provides a “Brand Portal” for IP owners to report claims of infringement. A key requirement for using the portal is having a trademark registered with the United States Patent and Trademark Office (USPTO). For those without portal access, claims can also be submitted through a general online IP Claim Form.
